Scope: a U.S.-organized entity wholly owned by a foreign person and treated as disregarded for the relevant federal rules. Confirm that status and the tax year with your adviser. Foreign ownership alone does not put every LLC in this category. This is a document-preparation guide, not a return or filing service.
Confirm what is being extended
The special Form 5472 instructions say a foreign-owned U.S. DE required to file attaches Form 5472 to a pro forma Form 1120 by that Form 1120’s due date, including extensions. The same instructions give a specific Form 7004 route for requesting more time.
A U.S. state formation, an EIN notice and a foreign owner’s address do not alone confirm that this special route applies. Keep the ownership/classification evidence and the tax year beside the adviser’s conclusion. A different classification may require a different return and procedure.
Form SS-4
Requests the EIN. It does not extend a tax return.
Form 7004
Requests more time for the return identified on it. It is not the completed return.
5472 + pro forma 1120
The special filing package when required for a foreign-owned U.S. DE. Its filing evidence remains a separate item.
Use the special instructions, not a generic filing address
Under Form 5472 instructions → When and Where To File → Foreign-owned U.S. DEs → Extension of time to file, the DE must file Form 7004 by the regular due date, excluding extensions. Enter the code for Form 1120 on Part I, line 1, because Form 5472 attaches to a pro forma Form 1120, and write “Foreign-owned U.S. DE” across the top of Form 7004.
Dedicated fax or mailing destination
The instructions direct this DE to fax or mail Form 7004 to the same special destination specified there, rather than the regular Form 7004 filing address.
- Fax
- 855-887-7737. The instructions specify fax at 300 DPI or higher for the special filing route.

The general Form 7004 instructions permit electronic filing for many returns. Do not substitute that general statement for the specific fax/mail direction for this DE. Separately, the Form 5472 instructions say a foreign-owned U.S. DE cannot file Form 5472 electronically.
Put the regular due date and the extension evidence on different lines
The Form 7004 instructions generally describe a six-month filing extension, subject to their exceptions and proper, timely filing. They direct you to the applicable return’s instructions for the regular due date. This page does not calculate your date, select a tax year or promise an extension merely because a document was prepared.
The IRS says it no longer sends an approval notification for the extension; it notifies you if the request is disallowed. Do not invent an approval letter requirement, but do not treat the absence of a notice as proof that an incomplete or late request was properly filed.
Prepare six groups of evidence for the review
- Scope and period
- Entity’s private identification reference, ownership/classification conclusion, tax year and who confirmed them.
- Regular due date
- Date, applicable return instructions and the adviser’s reasoning. Mark “unconfirmed” until it is resolved; keep it distinct from the proposed extended date.
- Exact extension copy
- The complete Form 7004 copy, the return identified on line 1 and the required foreign-owned U.S. DE notation. These are review checks, not an invitation to upload it here.
- Submission record
- Method, destination, date, complete copy/page count and evidence linked to exactly what was sent. A draft or “we will file” message does not establish transmission.
- Outcome and follow-up
- Any rejection/disallowance correspondence, unresolved question and responsible reviewer. Preserve the evidence even when no approval notice is expected.
- Return and payment tasks
- Track the later 5472/pro forma 1120 package and any separately applicable payment/other-return questions. An extension request does not close these tasks.
Three claims that need different evidence
“The provider has prepared my extension”
An owner has a PDF named “7004 draft” and an email promising submission. The regular due date has not been confirmed in the file. Label it prepared; filing unproved. Ask for the complete copy, due-date basis and submission evidence. Do not mark the return filed.
“The fax says delivered”
A fax report is linked to a specific Form 7004 copy and destination. Preserve that transmission evidence, then review timeliness, completeness and the applicable instructions. Delivery alone does not establish every condition for a valid extension, and it does not file the later reporting package.
“I have my EIN, so I must be finished”
The file has an EIN notice but no extension or reporting-package evidence. The notice identifies the account; it proves neither Form 7004 filing nor Form 5472 filing. Resolve those tasks independently. Do not request a second EIN as a substitute.
Leave the review with named, separate tasks
Ask the reviewer to confirm the special DE scope, regular due date, required request copy/destination and evidence still missing. Keep the eventual return package and any payment obligations on their own task lines.
